What is Probate?
Probate is the formal judicial proceeding that proves or confirms the validity of a will. It is the legal process primarily used to transfer title of property from the person who has died (the decedent) to the one who is allowed to take title to the property. A person may be permitted to take title to property only when the decedent has willed the property to the person through the execution of a valid will (testate decedent). Alternatively, a person may be allowed to take title to the property if the decedent died without a will (intestate decedent) making the person one of the decedent’s legal heirs under state law. Probate Procedures
The ability to exercise ownership rights over the decedent’s property will not be effective without using one of the probate procedures recognized under Texas law. By way of example, if the decedent willed an acre of land to a particular person, that person could not officially own and sell the acre of land unless his or her name appears in the deed records, prepared through the use of a valid probate procedure. To assure that ownership rights are protected, it is important to follow the appropriate rules under Texas law.
